South Africa’s Foreign Minister, Naledi Pandor, reiterated her government’s stance this week, affirming that South African citizens engaged in combat with the Israeli Defense Forces (IDF) in Gaza will face arrest upon their return home. Pandor made these remarks during a gathering of the African National Congress, stating, “We are ready. When you come home, we’re going to arrest you,” as reported by The Times of Israel.
This announcement follows a prior warning issued by the South African foreign ministry in December, which highlighted concerns over potential violations of international law by individuals participating in the conflict in Gaza. The ministry cautioned that such actions could render individuals “liable for prosecution in South Africa” and could even result in the revocation of citizenship for naturalised citizens.

The South African government’s concern regarding its citizens’ involvement with the IDF stems from its commitment to upholding arms control laws, which require individuals to obtain permission before engaging in military activities abroad. Notably, under Israeli Security Service law, all citizens, regardless of residency status, are obliged to serve in the military.
South Africa’s vocal opposition to Israel’s actions in Gaza has been evident in its recent filing of a case against Israel at the International Court of Justice, alleging violations of the UN Convention on the Prevention and Punishment of the Crime of Genocide of 1948.
The ongoing conflict between Israel and Gaza, which erupted following an attack by Palestinian militant group Hamas in October, has resulted in significant casualties and widespread destruction. South Africa’s proactive stance underscores its commitment to justice and accountability in the face of global conflicts.
